借金の整理
借金がかさんで，支払いができない，という状態に陥ってしまった場合，法的に解決することができます。
方法としては，大まかに言って，任意整理，個人再生，破産という方法があります。
今日は，主に任意整理手続きの話をしようと思います。
任意整理とは，弁護士等が，債務者と業者との間に入って話し合い，債務を減額，又は元本限りにして，概ね３?５年の間で支払いをする約束を各業者毎に取り付ける，という手続きです。債務についての，返済方法の再編，と考えるとわかりやすいかもしれません。
この場合，取引状況によっては，債務がほとんどなくなったり，過払いといって，払いすぎた利息が返ってくることもあります。
ただ，法改正により，これからはあまり高い利息は取れなくなりますので，上記のような過払金の発生は減ってくると思われます。
個人再生や破産については，また項を改めて記載したいと思います。
また，弁護士が間に入って，債権者に受任通知を送付した段階で，直接債務者に対して支払いの督促が来ることはなくなります。
これは，任意整理でも個人再生でも破産でも，借金の整理手続には共通した効果です。
